1. Agency Role & Responsibilities

AreYouTripping (“Agency”) acts solely as an independent travel advisor and intermediary between clients and travel suppliers, including but not limited to airlines, cruise lines, hotels, resorts, tour operators, transportation companies, and other service providers (“Suppliers”). The Agency does not own, operate, or control any Supplier and is not responsible for their acts, omissions, errors, delays, cancellations, bankruptcies, or failures to provide services.

2. Client Responsibilities & Accuracy of Information

Clients are responsible for providing accurate and complete information, including legal names exactly as they appear on government-issued identification, dates of birth, passport details, and contact information. The Agency is not responsible for errors, penalties, or denied travel resulting from incorrect or incomplete information provided by the client.

3. Payments, Pricing & Authorization

Prices are not guaranteed until paid in full and may change due to supplier pricing, availability, fuel surcharges, taxes, or currency fluctuations. By authorizing payment, the client agrees to all supplier terms and conditions, including cancellation and refund policies. Credit card authorization constitutes acceptance of these Terms & Conditions.

4. Service Fees

AreYouTripping may charge professional service or planning fees for itinerary design, research, ticketing, changes, or cancellations. Service fees will be openly disclosed and are non-refundable once work has begun, regardless of trip outcome.

5. Cancellations, Changes & Refunds

All cancellations and changes are subject to Supplier rules and penalties, which may include total loss of funds. Refund timelines are determined by Suppliers, not the Agency. The Agency is not responsible for supplier-imposed penalties or delays in refunds.

6. Travel Insurance Disclosure

Travel insurance is strongly recommended to protect against unforeseen circumstances such as trip cancellation, medical emergencies, delays, interruptions, supplier default, or evacuation. Declining travel insurance releases AreYouTripping from liability for losses that may have been covered by insurance.

7. Passports, Visas, Entry & Health Requirements

Clients are responsible for ensuring compliance with passport validity, visa requirements, vaccinations, and health regulations for all destinations. The Agency is not responsible for denied boarding, denied entry, or additional costs due to noncompliance.

8. Assumption of Risk

Travel involves inherent risks, including but not limited to illness, injury, accidents, weather conditions, political instability, natural disasters, and acts of force majeure. By booking travel, the client voluntarily assumes all such risks.

9. Limitation of Liability

To the fullest extent permitted by law, AreYouTripping shall not be liable for any injury, loss, damage, expense, delay, inconvenience, or claim arising from travel arrangements, Supplier actions, or events beyond the Agency’s control.

10. Chargebacks & Disputes

Clients agree not to initiate credit card chargebacks without first contacting the Agency to attempt resolution. Unauthorized chargebacks may be disputed and documented with signed agreements and supplier terms.

11. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Illinois. Any disputes shall be resolved exclusively in Illinois courts.

12. Acceptance of Terms

By booking travel, signing an invoice, or submitting payment, the client confirms they have read, understood, and agreed to these Terms Of Services in full.
